Article 1 - Prices

1.1 - The prices of our products are indicated in euros excluding participation in processing and shipping costs.
1.2 - www.grintech.eu reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time of registration of the orders.
1.3 - The products remain the property of www.grintech.eu until full payment of the price by grintech.eu
1.4 - The products and services sold on www.grintech.eu are reserved for individuals.

Article 2 - Order

grintech.eu reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.

Article 3 - Validation

You declare that you have read and accepted these general terms and conditions of sale before placing your order. Validation of your order therefore constitutes acceptance of these General Terms and Conditions of Sale.
Unless proven otherwise, the data recorded by www.grintech.eu constitutes proof of all transactions made by its customers.

Article 4 - Availability

Our product offers and prices are valid as long as they are visible on the site, within the limit of available stocks. Our product offers are proposed within the limit of available stocks.
In the event of a product being unavailable after placing your order, we will inform you by email or by post upon receipt of the information received from the suppliers.

Article 5 - Delivery

5.1 - General
Products purchased on www.grintech.eu are delivered in Europe. The indicative shipping period is mentioned to the customer prior validating the order and corresponds to the processing and shipping time to which is added the delivery time. The products are delivered to the delivery address that you indicated during the ordering process. When you order several products at the same time and they have different shipping times, the order shipping time is based on the longest period.
www.grintech.eu reserves the right to split shipments. Participation in processing and shipping costs will only be charged for a single shipment. www.grintech.eu cannot be held responsible for the consequences due to a delay in delivery. The maximum delivery time is 30 days from the order.
In the event of a delay in shipping, an email will be sent to you.

In the event of payment by check, the order will only be processed upon receipt of the check. Consequently, the deadlines applicable in this case are those on the day the check is received and may therefore be modified compared to those mentioned on the day the order is placed.

5.2 - Delivery problems
You must notify the carrier and www.grintech.eu of any reservations about the product delivered (for example: damaged package, already opened, etc.). Then, depending on the cases defined in article 13.1 below, you can benefit from the exchange and reimbursement conditions provided for in this article.

Article 6 - Payment

Payment for your purchases is made:
- either by bank transfer
- or by bank checks
In the event of payment by bank check, it must be issued by a bank domiciled in metropolitan France or Monaco. The check will be cashed upon receipt. The check will be payable to grintech.eu and sent to grintech.eu, ZA LAVALDUC, 15 RUE PIERRE GILLES DE GENNES, 13270 FOS SUR MER

Article 7 - Reimbursement

Reimbursements for products in the cases referred to in Article 5 will be made within 15 days or less after receipt of the products by us.
Reimbursement will be made at www.grintech.eu's choice by credit to your bank account or by bank check addressed to the name of the customer who placed the order and to the billing address.
No cash on delivery will be accepted for any reason.

Article 10 - Liability

The products offered comply with current French legislation and the standards applicable in France. www.grintech.eu cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered (for example, in the event of a product ban, etc.). It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you plan to order.
www.grintech.eu is only responsible for the content of the pages it publishes.
In the event of a manifest error between the characteristics of the product and its representation and/or the conditions of sale, www.grintech.eu cannot be held liable. Of course, for any questions about the products, you can contact our Customer Service.
In the event of professional purchases, www.grintech.eu will not incur any liability for any indirect damages resulting from these terms, loss of business, loss of profit, loss of opportunity, damages or costs, which could arise from the purchase of the products. The total or partial impossibility of using the products, in particular due to hardware incompatibility, cannot give rise to any compensation or reimbursement or questioning of the liability of www.grintech.eu
Our products have performances compatible with professional uses even if www.grintech.eu is not intended to sell to professionals. www.grintech.eu cannot therefore be held liable for any damage whatsoever resulting from a professional activity.

Article 11 - Warranty

11.1 - Legal warranty
We undertake, at your choice, to reimburse you or exchange "within 7 days". If you request a refund via www.grintech.eu, please contact our Customer Service at XXXXXXX. The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions, etc.). In any case, you benefit from the legal guarantees of conformity of the goods to the contract and hidden defects and this in accordance with the legal provisions.

 

11.2 - Contractual warranty
Products purchased on www.grintech.eu may be entitled to a warranty. This is indicated on the product product sheet presented on the site. In order to know the steps to follow regarding after-sales service for any problem or breakdown on a product, you can contact Customer Service. In order to benefit from the product warranty, it is imperative to keep the purchase invoice for the product.
Contractual warranties do not cover:
- abnormal or non-compliant use of the products. In this regard, we invite you to carefully consult the instructions for use provided with the products.
- breakdowns related to accessories (power cables, etc.).
- defects and their consequences due to the intervention of a repairer not approved by www.grintech.eu
- defects and their consequences related to use not in accordance with the use for which the product is intended (professional, collective use, etc.).
- defects and their consequences related to any external cause.
However, in any event, you benefit from the provisions of the legal guarantee, in particular those relating to the legal guarantee specified in Article 11.1 above.

Article 12 - Applicable law - Disputes

This contract is subject to French law. The language of this contract is French. In the event of a dispute with professionals and/or traders, the courts of Aix en Provence (France) will have jurisdiction.
In the event of a dispute, the French courts will have sole jurisdiction.

Article L211-4 Consumer Code
The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity that exists at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been placed on him by the contract or has been carried out under his responsibility.

Article L211-5 Consumer Code
To comply with the contract, the goods must:
1° - Be suitable for the use usually expected of a similar good and, where applicable:
A) correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model.
B) have the qualities that a buyer can legitimately expect in light of the public statements made by the seller, the producer or his representative, in particular in advertising or labeling.

Article 1641 Civil Code

The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.
ARTICLE 14: TRANSPORT COSTS AND RISKS
www.grintech.eu reserves the right to charge shipping costs for any repaired or exchanged goods. www.grintech.eune may be liable for the risks associated with the transport of its goods. Loss, damage and delays caused by transport of the goods are not the responsibility of www.grintech.eu
